Compliance Hotline

Clients of Automotive Systems Analysis are provided a host of services.  Every ASA client is provided unlimited access to our compliance hotline number to receive expert guidance from our staff concerning the myriad of laws governing sales, finance and advertising.  Our staff is comprised of attorneys, former DMV investigators and specially trained consultants who are available to answer any questions a dealer may have concerning regulatory compliance issues.  Unlike other consulting companies, ASA clients have access to a licensed and practicing California attorney who is actively involved in the defense of dealers in civil and administrative cases.

Newsletters

ASA clients are provided with quarterly Newsletters addressing critical and timely regulatory enforcement trends or civil litigation issues confronting the industry. In addition, dealers are updated on the latest legislative or DMV procedural changes.

Quarterly Audits

Auto Systems provides its clients with quarterly reviews of the dealership's records and provides the owner with a confidential, written analysis in several critical areas.  The quarterly review is aimed at identifying whether the dealership is developing any adverse trends in high profile areas, whether controls should be implemented in a particular area or whether management attention is lacking in a particular area.

The areas analyzed during the quarterly inspections include but are not limited to the following:


Advertising

The dealership's advertising is reviewed on an ongoing basis for compliance with federal and state regulatory requirements.  The firm subscribes to local print media and performs post-publication reviews of the advertisements on a monthly basis.  Any adverse findings or trends are identified in the quarterly report and/or reported directly to the owner when first discovered.

Contracts

The quarterly reviews include an inspection and review of random sales occurring during the review period.  Within the dealership's sales jackets, the conditional sales and lease contracts are reviewed for compliance with Civil Code and Vehicle Code requirements. Dealer contracts are reviewed for compliance with high profile enforcement areas such as the "Single Document Rule," Federal Regulation Z, deferred down payments, negative equity and accurate completion of fees.

Disclosure Documentation

The inspection of random sales includes an analysis into the dealer's adherence to state and federal disclosure requirements.  More particularly, transactions requiring special history disclosure (i.e. rentals, demonstrators, company service vehicles, etc.) are reviewed for compliance with Vehicle Code requirements.  Other disclosure items inspected include federal odometer requirements, F.T.C. Buyers Guide requirements, and other Vehicle Code requirements (i.e. tire chain disclosure, after market accessories, service contracts, etc.).  We also review all deals for AB 68 compliance, ("Car Buyers Bill of Rights").

Inventory Disclosure

A physical review of the dealership's inventory is conducted to determine the dealer's compliance with federal and state inventory requirements.  Monroney Stickers and Buyers Guides are reviewed for compliance with federal requirements and dealer supplemental stickers are reviewed for compliance with Vehicle Code requirements.

Occupational Licensing

The dealer's occupational licensing (dealer's license, sales licenses, management licenses, etc.) are regularly reviewed for compliance with Vehicle Code requirements.

Vehicle Registration

The quarterly reviews include an analysis into the firm's handling of official fees required by the Department of Motor Vehicles.  For instance, Administrative Service Fee assessments are obtained from the Department of Motor Vehicles each month and the assessments are recapped in the quarterly report.  Further, the dealer's refunding procedures and business office's handling of DMV fees are reviewed to determine if any problem areas or adverse trends exist.

DEALER EDUCATION

Automotive Systems Analysis has been an approved provider of both the Used Vehicle Dealer Education Class and Continuing Education Class since the requirements were enacted in 1998.  The class curriculum was created by Robert Robards, an attorney specializing in dealer regulatory compliance and representing over 300 dealers in California, and the classes are taught by Sue Lankford a former Investigator for DMV.
